Terms of Service

These terms govern your use of the public Cairn site and any pre-release access to Cairn we provide unless a separate written agreement says otherwise.

The short version: Cairn is a business product for regulated software teams, it is still evolving, and nothing on this site or in the product should be treated as legal, medical, or regulatory advice.

1. What these terms cover

These Terms of Service apply to your use of cairn.services and to any demo, pilot, beta, or other early-access version of Cairn we make available to you.

If you or your organization enter into a separate order form, pilot agreement, services agreement, or other written contract with us, that agreement controls to the extent of any conflict.

2. What Cairn is

Cairn is software designed to help medical device and SaMD teams manage regulatory and quality work, including documentation, readiness tracking, and compliance workflows.

Cairn is AI-assisted and may generate summaries, drafts, recommendations, or other outputs based on information you provide or systems you connect.

3. Eligibility and authority

You may use the site and request access only if you can form a binding agreement with us. If you are acting for a company or other entity, you represent that you have authority to bind that entity.

4. Acceptable use

You agree not to:

  • Use Cairn or this site for unlawful, fraudulent, or abusive purposes.
  • Interfere with the site, infrastructure, or security of the service.
  • Misrepresent your identity, company, or regulatory intent.
  • Reverse engineer, scrape, or extract the service except as permitted by law.
  • Use the service to infringe the rights of others or upload content you do not have rights to use.

5. Product output and professional judgment

Cairn can help draft and organize compliance materials, but you remain responsible for reviewing outputs and making your own regulatory, quality, engineering, legal, and clinical decisions.

Cairn is not a law firm, regulatory consultant, notified body, FDA representative, or medical provider. Nothing on the site or in the service is legal advice, medical advice, or guaranteed regulatory clearance guidance.

6. Intellectual property

The Cairn name, branding, site content, and software are owned by us or our licensors and are protected by intellectual property laws.

You retain rights to content and data you provide, subject to the rights needed for us to operate, support, and improve the service.

7. Feedback

If you send us feedback, suggestions, or product ideas, we may use them without restriction or compensation to you.

8. Early-access status

Cairn is currently offered on a limited-access basis. Features may change, be incomplete, or be discontinued. We may suspend or revoke early access at any time.

Unless we expressly agree otherwise in writing, access provided during an early-access period is for evaluation and business use at your own risk.

9. Fees

Access to the public marketing site is free. Any paid access to Cairn, if offered, will be governed by separate commercial terms.

10. Disclaimer of warranties

The site and service are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or error-free operation.

11. Limitation of liability

To the maximum extent permitted by law, The Brooklyn App Company will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of Cairn or this site.

12. Indemnification

You agree to indemnify and hold harmless The Brooklyn App Company and its personnel from claims, losses, liabilities, and expenses arising from your misuse of the site or violation of these terms.

13. Termination

You may stop using the site at any time. We may suspend or terminate your access to the site or early-access product at any time, including if we believe you have violated these terms.

14. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute arising from these terms will be resolved in the state or federal courts located in Kings County, New York.

15. Changes to these terms

We may update these terms from time to time. When we do, we will update the "Last updated" date above. Continued use after changes take effect means you accept the updated terms.
